Welcome to XMotive Dance Studio (“XMotive,” “Studio,” “we,” “our,” or “us”).


These Terms of Service govern your access to and use of **XMotiveDance.com**, studio rentals, memberships, bookings, and all related services.


By booking, registering, or using our website, you agree to these Terms.

 1. ACCEPTANCE OF TERMS


By accessing XMotiveDance.com or using our services, you acknowledge that you:


* Are at least 18 years of age

* Have authority to enter into this agreement

* Agree to be legally bound by these Terms


If you do not agree, you must discontinue use immediately.

2. SERVICES PROVIDED


XMotive Dance Studio provides:


* Private event space rentals

* Dance team programs and classes

* Instructor studio memberships

* Vendor referrals and directory listings

* Online booking and reservation services

* Studio-hosted events


All services are subject to availability and may change at any time without notice.

3. BOOKING & PAYMENT TERMS


Deposits


Deposits secure calendar availability only.


Certain promotional or limited-time pricing may require only a deposit to reserve a date. Deposits are applied toward the total rental cost when applicable.


Payment Requirements


* Remaining balances must be paid according to your booking agreement.

* Failure to pay may result in cancellation.

* XMotive reserves the right to refuse service for unpaid balances or at it's discretion


All payments are processed securely through our approved payment systems.

4. CANCELLATION POLICY


All deposits and payments are **NON-REFUNDABLE**.


Deposits reserve your date and remove availability from our calendar.


If cancellation occurs:


* Rescheduling may be permitted at XMotive’s discretion

* Requests must be submitted in writing

* No refunds are guaranteed

5. DAMAGE & LIABILITY


The booking client is fully responsible for:


* Guest conduct

* Property damage

* Excessive cleaning

* Equipment misuse


This includes but is not limited to:


* LED lighting systems

* Mirrors

* Walls and flooring

* Tables and chairs

* Audio equipment


Damage or cleaning fees may be billed after the event.



6. CONDUCT POLICY


XMotive maintains a professional and safe environment.


The following may result in immediate termination of services without refund:


* Fighting or aggressive behavior

* Illegal activity

* Property destruction

* Exceeding occupancy limits

* Unauthorized alcohol service

* Disruptive or unsafe behavior


Law enforcement may be contacted if necessary.




7. STUDIO ACCESS


Access is limited strictly to your booked time.


* Early entry is not permitted without approval

* Late departures may result in additional hourly charges

* Guests must remain inside designated studio areas

8. MEMBERSHIPS & INSTRUCTORS


Memberships and instructor access:


* Are non-refundable unless required by law

* May be suspended for misconduct or nonpayment

* Do not guarantee exclusive access outside scheduled hours


XMotive reserves the right to terminate membership privileges at any time.

9. VENDOR DIRECTORY & THIRD-PARTY SERVICES


XMotive may provide vendor listings or referrals.


We:


* Do not guarantee vendor performance

* Are not liable for vendor-client agreements

* Are not responsible for third-party services


All vendor contracts are independent of XMotive.

10. WEBSITE USE


You agree not to:


* Attempt unauthorized access

* Interfere with booking systems

* Copy or distribute proprietary content

* Misuse website features


Violation may result in restricted access.

11. PHOTO & VIDEO RELEASE


XMotive may photograph or record events for marketing purposes.


By participating in services or events, you grant XMotive permission to use images or video unless written opt-out notice is provided prior to the event.

12. LIMITATION OF LIABILITY


XMotive Dance Studio is not liable for:


* Personal injury

* Lost or stolen property

* Guest actions

* Vendor disputes


Participation and use of the facility is at your own risk.

13. PAYMENT DISPUTES & CHARGEBACK POLICY


By submitting payment through XMotiveDance.com or any authorized payment processor, you acknowledge and agree that all payments made toward bookings, memberships, classes, or services are subject to the cancellation and refund policies stated within these Terms.

Clients agree to contact XMotive Dance Studio directly to resolve any billing concerns prior to initiating a chargeback or payment dispute through a bank or credit card company.

Initiating a chargeback for services rendered, dates reserved, or deposits paid may result in:

  • Immediate cancellation of current or future reservations.
  • Suspension or termination of membership privileges.
  • Loss of promotional pricing or booking eligibility.

XMotive reserves the right to submit all relevant documentation to financial institutions in response to disputes, including but not limited to:

  • Booking confirmations.
  • Signed agreements or acknowledgments.
  • Communication records.
  • Website policy acceptance records.
  • Studio access logs.

Clients remain financially responsible for legitimate charges associated with reserved services.


14. RESERVATION COMMITMENT ACKNOWLEDGMENT


Clients understand that studio availability is limited and that accepting a reservation removes that date and time from availability to other clients.

Deposits and promotional booking payments compensate for reserved calendar time and administrative preparation.

Failure to attend or voluntary cancellation does not constitute grounds for a refund.


15. SURVEILLANCE & SECURITY ACKNOWLEDGMENT


For the safety and protection of clients, guests, staff, and property, XMotive Dance Studio utilizes video surveillance and security monitoring within common areas of the facility.

By entering the premises or participating in studio activities, clients and guests acknowledge and consent to video monitoring.

Surveillance footage may be used for:

  • Safety and incident review.
  • Property damage investigations.
  • Payment or liability disputes.
  • Legal compliance when required.

Private areas such as restrooms are never monitored.


16. LIMITATION OF USE & FACILITY PURPOSE


XMotive Dance Studio operates primarily as a dance, fitness, creative rehearsal, and private event studio.

Use of the facility must align with approved activities.

XMotive reserves the right to refuse or terminate services if an event or activity is determined to:

  • Create safety risks.
  • Exceed permitted use.
  • Violate local laws or studio policies.

Termination of services for policy violations does not entitle a client to a refund.


17. AGE REQUIREMENT


All bookings must be made by individuals 18 years of age or older.


XMotive services and marketing are intended for adults 18+.

18. CHANGES TO TERMS


XMotive reserves the right to update these Terms at any time.


Changes take effect immediately upon posting.

19. GOVERNING LAW


These Terms are governed by the laws of the Commonwealth of Virginia.
